Shri Divendu Tripathi, learned counsel for the petitioner submits that the salary of the petitioner has been incorrectly fixed. Further no opportunity of hearing was granted to the petitioner prior to the refixation of the salary at a reduced level. Ms. Anita Kushwaha, learned counsel holding brief of Shri Sanjay Kumar Om, learned counsel for the respondent No.2 and 3-Jal Nigam submits that the petitioner's salary has been fixed in compliance of the directions of this Court in Writ A No. 17904 of 2020 (Om Prakash and others vs. State of U.P. and others). While determining the salary, regard has been paid to all relevant provisions of law, government orders and circulars applicable to the facts of this case. Interest of justice will be served by granting the petitioner a post decisional hearing. The matter is remitted to the respondent no.3 with the following directions: i. The respondent no.3 shall notice the petitioner with the basis of fixation of salary of the petitioner along with relevant government orders/circulars holding the field. ii. Upon receipt of such notice the petitioner may file a response to the same. iii. The respondent no.3 shall thereafter decide the issue of fixation of salary of the petitioner by a reasoned order within a period of four months. The impugned order shall abide by the order to be passed by the respondent no.3 in compliance of the above directions. With the aforesaid directions, the writ petition is finally disposed of.
