After some arguments, the learned counsel for the appellant submits that in view of the subsequent developments and the other issues not being taken before the learned Trial Court on the earlier occasion when the bail was dismissed vide the impugned order dated 07.12.2024, the present appeal be disposed of granting liberty to the appellant to move a fresh Bail Application before the learned Trial Court. He further prays that the impugned order, however, should not prejudice the decision on such an application. 2. The learned SPP for the respondent does not oppose the prayer made. 3. We, even otherwise, find merit in the said contention as much water has flown between the passing of the impugned order and today. 4. We, therefore, dispose of this appeal, reserving liberty in the appellant to file a fresh Bail Application before the learned Trial Court raising all the contentions. We make it clear that the impugned order shall not come in the way of the learned Trial Court in deciding such application afresh remaining uninfluenced by any observation made in the impugned order. We further clarify that the dismissal of the Bail Application by the impugned order will also not prejudice the appellant in such decision. The Bail Application, if moved by the appellant, be decided by the learned Trial Court within a period of two months of its filing. 5. The appeal stands disposed of in the above terms.
