In the suit instituted by plaintiff-respondent, cross examination of PW-1 was not completed and Court below directed for the examination of PW-2. The application moved by the petitioner was dismissed permitting the cross-examination of PW-1, against which, a revision was filed along with application for condonation of delay. The revisional Court had allowed the delay condonation application, but had rejected the revision. I have perused the material on record. I find that the Court below has recorded specific findings that the defendants were delaying the matter and not cross examining PW- 1, and the examination of PW-2 has already started, as such, there arose no ground for allowing the application for cross-examination of PW-1.
