Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 19.02.2025 [1] Heard Ms. W. Bidyarani, learned counsel for the applicants in MC(WP(C) No. 128 of 2025. [2] By the proposed application under Order VI Rule 17 of the CPC, the applicants/petitioners proposed to amend the heading of the writ petition to be as under Article 227 of the Constitution instead of Article 226. However, no substantial amendment is prayed for in the writ petition. [3] Mr. H. Debendra, learned Dy. G.A. assisted by Mr. Bheigya, learned counsel, submits that that the State respondent does not object to the proposed amendment. [4] This has Court perused the writ petition and application for amendment. In the writ petition, the petitioners challenged 3 (three) orders dated 23.03.2021, 05.04.2021 and 12.04.2021 passed by the Ld. SDM, Thoubal directing the petitioner for vacating the land acquired by the State through direct process. [5] This Court is of the opinion that there is no requirement of changing the nomenclature of the petition from Article 226 to Article 227 of the Constitution as the petitioner is aggrieved by the order passed by the Executive Magistrate under Cr.PC. [6] With this observation, the application is disposed of. [7] Ms. W. Bidyarani, learned counsel for the petitioner, submits that she may be given two weeks’ time for filing rejoinder affidavit to the counter affidavit filed by the State respondent.
