The learned counsel for the respondents pointed out that in pursuance to the order dated 23.07.2025, the respondents filed an affidavit pointing out the reasons for the delay in completing the departmental inquiry against the petitioner and also the reasons for not paying subsistence allowance. 2. Having gone through the affidavit we are of the opinion that no justifiable reason is provided for not paying the subsistence allowance to the petitioner. Furthermore, the learned counsel for the respondents make a statement that if the petitioner cooperate, within three months inquiry will be completed. 3. We accept the statement of the respondents as regard the completion of the inquiry within three months 2025:BHC-NAG:11668-DB 2 27.wp.3763.2025.odt alongwith the undertaking of the petitioner that he will cooperate inquiry officer to complete the inquiry within three months. 4. As there is no justifiable reason provided, for not paying subsistence allowance to the petitioner, we direct the respondents to pay the subsistence allowance alongwith the arrears of subsistence of allowance in accordance with law within a period of two months from today and henceforth pay the subsistence allowance regularly till the completion of the inquiry. 5.
