1. This matter is taken up through hybrid mode.
2. The petitioner has approached this Court with the following prayer:
“The petitioner therefore, prays that this Hon’ble Court be pleased to admit the writ petition issue a RULE NISI, calling upon the Opp.Parties to show case as to why the order under Annexure-3 series shall not be quashed and why a direction shall not be given to OP No.2 to allow the mutation case under Annexure-3 and if the Opp.Parties No.1 to 3 fail to show cause or shows insufficient cause then the said rule may be absolute by quashing the order under Annexure-3 and further be pleased to direct the OP No.2 issue the ROR in favour of the petitioner within the time stipulated by this Hon’ble Court.
And for this act of kindness, the petitioner shall as in duty bound ever pray.”
3. It is seen that by order dated 03.04.2024, the prayer of the petitioner for mutation was rejected on the ground that the OLR Ceiling Case No.30/1974 of Tahasildar, Deogarh is sub-judice. The petitioner has however, enclosed the order sheet of said OLR Ceiling case, which shows that the case has been disposed of. Therefore, there appears to be some confusion in the mind of the Tahasildar as regards status of the
Order No.

4. The writ petition is therefore, disposed of by setting aside the impugned order and by remitting the matter to the Tahasildar for hearing afresh. The petitioner shall appear before the Tahasildar on 29th of May, 2026 at 10.30 a.m. along with certified copy of order sheet in OLR Ceiling Case No.30/1974. Needless to mention that the Tahasildar shall thereafter consider the same and proceed in accordance with law and conclude the mutation case as early as possible, preferably within four weeks thereafter.
