Prayer in the instant petition filed under Article 226 of Constitution of India is for issuance of direction to respondents No.2 and 3 to protect the life and liberty of the petitioners at the hands of the private respondents.
Learned counsel for the petitioners has contended that on account of dire need of money, the wife of the petitioner, namely, Noor Jahan (since deceased) entered into an agreement to sell her land to respondents No.6 and 7 and received Rs.21,05,000/- as earnest money out of total sale consideration of Rs.28,10,000/-. As respondent No.6 could not arrange the money, he taking advantage of illiteracy of Noor Jahan, entered into another agreement dated 19.12.2020, without mentioning the date for execution of sale deed. After 7-8 months, when Noor Jahan came to know about non fixing of date of registration of sale deed, she several times requested respondent No.6 to pay the remaining amount and get the sale deed executed but when he failed to do so, she sent legal notice dated 25.09.2021 calling upon him to pay the outstanding amount and execute the sale deed. Accordingly on 11.10.2021 she went to the Tehsil Office for the said purpose but when respondent No.6 did not turn up she got her presence marked by executing an affidavit in the Tehsil Office. On the contrary, respondent No.6 served legal notice dated 29.11.2023 to the legal representatives of Noor KOMAL 2025.07.09 18:13 I attest to the accuracy of this document
CRWP-5484-2025 (O&M) -2- Jahan, calling upon them to perform part of the contract by remaining present in the Tehsil Office on 18.12.2023. Although, the matter is purely of civil nature but the private respondents in collusion with the police officials are exerting pressure upon the petitioner by summoning him in the Police Station. The petitioner, who is a senior citizen and heart patient, is being subjected to undue stress and harassment by the respondents which is in violation of his fundamental rights. In this regard, the petitioner sent representation dated 28.04.2025 to respondent No.3 and when no action was taken, the petitioner filed representation dated 02.05.2025 (Annexure P-5), before respondent No.3, but no action on the same has been taken till date. During the course of arguments, learned counsel for the petitioner has submitted that he would be satisfied if the representation dated 02.05.2025 (Annexure P-5), is looked into. Notice of motion. Mr. Arjun Lakhanpal, Addl. A.G., Haryana, accepts notice and submitted that she has no objection if the representation dated 02.05.2025 (Annexure P-5), is looked into.
In view of the above, the present petition is disposed of with a direction to respondent No.3-Senior Superintendent of Police, District Nuh, to look into the aforesaid representation and to take appropriate action as per law, if any required, at the earliest.
