The petitioner and respondent No. 3 are owners of different flats in a group housing in the name of Shatabdi Vihar developed by respondent No. 2 i.e., NOIDA. 3. The case of the petitioner is that respondent No. 3 is making structural changes in his flat and has even demolishing the load bearing beam threatening the structural safety of the entire building. The petitioner has, therefore, prayed for a writ of mandamus directing respondent No. 2 to take appropriate action to ensure safety of the building of the petitioner and to stop illegal construction going on in the said building. 4. It is stated that on 07.04.2025, NOIDA has issued a notice to respondent No. 3 in respect of the same aspect. It seems that respondent No. 3 has also replied to the same. However, the petitioner alleges that the construction and alteration in the flat is continuing unabated. 5. Shri Kaushlendra Nath Singh, learned counsel for the respondent, Development Authority, states that the Development Authority will take decision in pursuance of notice dated 07.04.2025, if not already taken. 6. Accordingly, the writ petition stands disposed of with direction to the respondent, Development Authority, to take decision strictly in accordance with law in pursuance of notice dated 07.04.2025.
