Present applicant–Ravi Srivastava S/o Shri Late Jagdish Srivastava is seeking bail in relation to FIR/Case Crime No.0479 of 2024, registered on the basis of FIR dated 16.12.2024 at Police Station Kashipur, District Udham Singh Nagar, wherein one Sukhram Pandit and one unknown person have been implicated for the offences punishable under Sections 109 of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated on two grounds, firstly, the applicant is not named in the FIR and secondly, the allegation as alleged in the FIR is highly improbable and it appears that these allegations have been alleged only with an intention to implicate the present applicant maliciously. She further submits that the applicant is not named in the FIR and his name has been disclosed by the other co-accused, who has been granted interim anticipatory bail by the Coordinate Bench on 09.01.2025. Apart from this, she submits that this is a case of no injury. 5. On the other side, learned State counsel opposed the bail application by submitting that the applicant has criminal history of two cases. Mr. Pankaj Joshi, learned AGA also apprises to this Court that the charge-sheet has already been filed. 2025:UHC:4063 6. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration that this is a case of no injury, and, furthermore, the charge-sheet has already been filed and as such there is no need of custodial interrogation of the present applicant, this Court is of the view that the applicant deserves to be enlarged on bail. 7. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 8. Let the applicant, namely, Ravi Srivastava, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
