ORDER:. This Criminal Petition under Section 482 of B.N.S.S. is filed seeking to enlarge the petitioner/accused on bail in Crime No.103/2024 of Eluru Rural Police Station, Eluru District registered initially for the offences punishable u/Sees.324, 323 lPC and later altered to See.323, 354 and 326 lPC. 2. Heard Sri K.Rameshbabu, learned counsel for the petitioner and Sri Neelothpal Ganji, learned Assistant Public Prosecutor for the Respondent-State. 3. Heard both sides. Perused the record. 4. The scene of offence is the precincts of a holy temple. For the Committee that has been managing temple, the victim woman was the Secretary by the time of the offence and the petitioner/accused was former Secretary. ln the backdrop of the allegations of defalcation of funds on the part of the petitioner, it was the petitioner/accused who approached the victim to permit him to sell books within the temple premises in the light of the fact that Swamy vari kalyanam was about to be performed in the temple. Denial on the part of the victim enraged they.a+;+/
EE f, accused who took out the mike road and beat on the head of the woman and all over the body. 5. Learned Assistant public prosecutor opposed the prayer of anticipatory bail by stating that the victim suffered grievous inJ'urieS and her modesty was outraged which have been alleged against the petitioner. 6, As one would notice that the offence was out of emotional imbalance on the part of the accused and it seems he intended to assert his supremacy and beat her. From the facts alleged it does not seem to be the case where the accused intended to outrage the modesty of a woman. The crime was registered on 25.3.2024 which means a year ago. The petitioner has been permanent resident of the address that was shown in the official records of the investigating officer. There are no crI-minal antecedents. so far eight witnesses were examined during investigation and the victim was discharged from the hospital. Considering the nature of the offence and the progress in the investigation, custodial interrogation does not seem necessary. Therefore prayer is granted.
5, ln the result, the criminal petition is allowed with the following conditions: i. In the event of his arrest, the petitioner/accused herein shall be released on bail on his executing a personal bond for Rs.15,000/- •-.isg,
