The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Complaint Case No. 27970 of 2022, as well as cognizance/ summoning order dated 05.02.2025 by which the learned Magistrate took cognizance under Sections 327, 354-B, 323, 504, 506 of I.P.C., Police Station- Khair, District Aligarh, pending in the court of Judicial Magistrate, Court No. 1, Aligarh. After some arguments, learned Senior Counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ bail application/ anticipatory bail application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
