Case No.117 of 2025 dated 30.05.2025 under Sections 103(1)/238/3(5) of the BNS, 2023. And In the matter of: Ashok Bardolai @ Alok Bardolai and others … petitioners Mr. Arindam Jana Mr. Yuvraj Chatterjee … for the petitioners Mr. Suman De Mr. Sarthak Mondal … for the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. The victim was having an illicit affair with a lady. They were caught red handed. The victim was assaulted by the villagers. Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the post-mortem report which shows infliction of several injuries on the body of the victim, statements of the witnesses and submits that the victim was accosted by the petitioners and taken to a salisi sabha. There he was brutalised and afterwards was confined for two days. He was assaulted by the petitioners time and again till he died. The accused tried to hide the dead body in the river-bed, from where it was recovered. 2 Considering the incriminating materials available in the case diary, I do not think this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
