Mr. C.K. Sharma, Advocate for the petitioner. Mr. R.S. Bisht, Additional C.S.C. for the State. By means of the instant petition, the petitioner claims that despite the order of the respondent no.3/the Chief Education Officer, Dehradun the respondent no.4/ The Committee of Management, Sanatan Dharm Inter College, Bannu, Race Course, Dehradun (“the college”) is not giving the financial benefit in terms of increment, which was due to him in the month of January, 2023. Heard. It is the case of the petitioner that he is Assistant Teacher (Mathematics) working in the college since 1993. The respondent no.4/The Committee of Management had illegally stopped one increment, which was payable in the month of January, 2023. This order was set aside by the respondent no.3/The Chief Education Officer, Dehradun, on 20.02.2025, and the respondent no.3/The Chief Education Officer, Dehradun, had
directed the respondent no.4/The Committee of Management to release the benefit of increment to the petitioner. When the respondent no.4/The Committee of Management did not comply with the direction dated 20.02.2025, of the respondent no.3/The Chief Education Officer, Dehradun, further a warning was issued to the respondent no.4/The
Committee of Management by the respondent no.3/The Chief Education Officer, Dehradun on 26.03.2025. Still, it is the case of the petitioner that he is not being paid increment by the respondent no.4/The Committee of Management.
Learned counsel for the petitioner would submit that the increment that was payable to the petitioner in the month of January, 2023, has illegally been stopped by the respondent no.4/The Committee of Management. That order was set aside by the respondent no.3/The Chief Education Officer, Dehradun, and it was directed that the respondent no.4/The Committee of Management shall pay the increment on due time, but still it has not been paid. Learned State Counsel would submit that the respondent no.3/The Chief Education Officer, Dehradun, may get his
order enforced within four weeks. As per the order of the respondent no.3/The Chief Education Officer, the petitioner is entitled to the increment. In fact, the respondent no.3/The Chief Education Officer, Dehradun, has also written about it. Therefore, the petition is
disposed of directing the respondent no.3/The Chief Education Officer to ensure that pursuant to order dated 20.02.2025, which is Annexure No.1 to the writ petition, the petitioner is paid increment within a period of four weeks.
