Neutral Citation No. - 2025:AHC:100744-DB Court No. - 21 Case :- WRIT - C No. - 17080 of 2025 Petitioner :- Shiv Bahadur Singh Respondent :- State Of Uttar Pradesh And 4 Others Counsel for Petitioner :- Amar Nath Vishwakarma Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J.
1. The following prayer has been made in the writ petition:
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2and 3 to remove illegal possession and interference of the respondent no. 4 and 5 from the house of petitioner situated over Beniram Katra to Kaushambi Road comes under Village Basuhar, Pargana and Tehsil Chail, District Kaushambi within specified period."
2. A perusal of the averments made in the writ petition reveals that the dispute is between the petitioner and respondents no. 4 and 5, who are private persons, in relation to possession and title over immovable property.
3. In our considered opinion, the petition is wholly misconceived, as adjudication of rights in relation to immovable property involving disputed questions of fact could not be undertaken in exercise of writ jurisdiction.
4. At this stage, counsel for the petitioner prays for dismissal of the petition as not pressed.
5. Accordingly, dismissed as not pressed. (Ram Manohar Narayan Mishra, J.) (Manoj Kumar Gupta, J.) Order Date :- 1.7.2025 gp Digitally signed by :- GANESH PRAKASH High Court of Judicature at Allahabad
