1. Bail is sought for in this application in favour of applicants in connection with case FIR no.116/2023 under Section 370, 109 IPC, registered in police station Hajin, on the grounds made mention of therein. 2. Objections have been filed by respondent. 3. A threshold attention of this Court is being invited to the Order dated 11th September 2024, passed by a Coordinate Bench of this Court while considering interim application, being CrlM no.1293/2024, granting interim bail in favour of applicant no.2, namely, Abdul Qayoom Khan for a period of 40 days and that on completion of 40 days, applicant no.2 surrendered before Superintendent Central Jail, Srinagar. It is being stated that applicant no.2, during this period of 40 days when he was on interim bail, has not indulged in any act/activity that would be taken as impediment for grant of regular bail in his favour. It is being also stated that one of the accused, namely, Mst. Shahida Jan @ Sadiya has been given bail by the Principal Sessions Judge, Bandipora, vide order dated 28th October 2024. 2 Bail App No.18/2024
4. Bail, although earlier sought for by applicants, was not granted as their application was dismissed by the court of Principal Sessions Judge, Banidpora, vide order dated 2nd February 2024. 5. Having regard to the case set up by applicants and submissions made by counsel for parties, the application is allowed.
Applicants are enlarged on bail subject to their furnishing of bail bond in the amount of Rs.50,000/- each to the satisfaction of Registrar Judicial of this Court, with two sureties of the like amount to the satisfaction of Incharge/Superintendent, Jail/Sub- Jail concerned, on the following conditions: a. Applicants shall remain present before the Trial/Sessions Court on every date of hearing; b. Applicants shall furnish/intimate their whereabouts to concerned SHO on first day of every month; c. Applicants shall not directly or indirectly make any inducement, threat or promise to any person(s) acquainted with the facts of the case so as to dissuade him/them from disclosing such facts to the Court or to any Police Officer, as the case may be; d. Applicants shall not leave Kashmir Division without proper permission from the Court; e. Applicants shall not tamper with the evidence or witnesses in any manner and shall not be a source of embarrassment and harassment to any of the witnesses in any manner; f. Applicants shall not obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police; g. Applicants shall not commit an offence similar to the offence of which they are accused, or suspects, of the commission of which he is suspected. 6.
