1. Mr. Lalit Sharma and Mr. Bharat Chaudhary, learned counsel for the applicant.

3. The present applicant ‘Babit Kumar’ S/o Shri Nathu Singh is praying for regular bail in relation to First Information Report dated 17.03.2025 bearing FIR No. 174 of 2025 P.S. Pahtri, District Haridwar, which was lodged against as many as 13 named person and one unknown person for the offences punishable under Sections 103(1), 190, 191(2), 191(3), 61(2)(A) of BNS, 2023 r/w Section 3(1)(r) and 3(2)(v) of the SC and ST Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated, which is also evident from the fact that the applicant is not named in the FIR.
5. Apart from this, he submits that in respect of this incident another FIR was also lodged by the the wife of the present applicant and in this incident the applicant along with his two sons have also been implicated.
6. He further submits that one of the person, who is named in the FIR, namely, Harsh Mehta who was wrongly named in the FIR as Harsh Chaudhary have already been enlarged on bail by this court on 28.04.2025 in which the complainant was represented by Mr. Narendra Bali and Mrs. Prabha Naithani.
7. Mr. V.S. Pal, learned A.G.A. have not disputed this fact that the applicant is not named in the FIR and the other co accused have already been enlarged on bail, who was named in the FIR.
8. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the other co accused, who is named in the FIR, have already been enlarged on bail by this court on 28.04.2025, this court is of the view that the applicant also deserves for bail
2025:UHC:3658 particularly when the applicant is not named in the FIR.
9. Accordingly without expressing any opinion on the merit of the case, the bail application is allowed.
10. Let the applicant ‘Babit Kumar’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the Magistrate concerned.
11. It is made clear that after being released on bail the application shall cooperate with the investigation of both the FIRs i.e. FIR No. 174 of 2025 and FIR No. 177 of 2025 registered in the same police station.
12. It is also made clear that the grant of this bail will not be treated as a precedent in respect of other co accused.
