GP FOR FINANCE PLANNING The Court made the following: 2 HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.3298 of 2025 O R D E R:- This writ petition is filed for non-payment of Rs.54,92,432/- due to the Petitioner for works done vide Agreement No.100/2023-2024 dated 10.11.2023 i.e. laying of CC roads and restoration of damaged existing CC roads in MPPS School area of Velamavaripali in Pulivendula Municipality. The Petitioner submitted that though the works were executed and vouchers were made in M Book, the amount due to the Petitioner is not paid. 2. Learned standing counsel for the Respondents passed on written instructions signed by the Commissioner, wherein it was mentioned that the Municipal Assistant Engineer had recorded measurements of the work and the Executive Engineer (Public Health) had tested the works executed by the Petitioner and bills have been raised to a tune of Rs.62,06,047/- and for the net amount of Rs.54,92,432/- for the works executed by the Petitioner. It was further mentioned in the written instructions that the bill amount as claimed by the Petitioner is waiting for fund 3 clearance with the bill CFMS ID No.2024-282552, and that the amounts would be released to the Petitioner as and when the funds are released by the Government. The written instructions signed by the Commissioner, Pulivendula Municipality are placed on record. 3. Taking into considering the written instructions and as the work under the agreement was completed to the satisfaction of the Respondent-Authorities and as the amount due to the Petitioner is also admitted, this writ petition is disposed of with following direction that; (i) the Respondents are directed to pay the amount due to the Petitioner within a period of four (4) months from today.
