Heard Shri Virendra Singh, counsel for the petitioner and Ms.Anita Kushwaha holding brief of Shri Sanjay Kumar Om, counsel for the respondents. The grievance of the petitioner in the present petition is that the U.P.Jal Nigam (Rural), District Aligarh and its officers are interfering in the possession of the petitioner over Plot No.354-M area 0.115 Hectare and making constructions over the same. The petitioner claims that she has become the Bhumdar of the same plot after maturing her rights as the allottee of an agricultural land. By an order dated 29.2.2016 passed in proceedings registered under Sections 33/39 of the U.P Land Revenue Act, 1901, the claim of the petitioner was expunged from the revenue records. As a consequence of the order dated 9.10.2024 passed by the Commissioner, Aligarh Division, Aligarh in Revision No.261 of 2022 registered under Section 219 of the U.P Land Revenue Act, 1901, the name of the petitioner has again been restored in the revenue records. It has been stated in the petition that despite the aforesaid facts, the U.P Jal Nigam and its officers are illegally interfering in the ownership and possession of the petitioner. The claim of the petitioner can be decided by the revenue authorities, therefore, it would serve no useful purpose to keep the writ petition pending. The petition is disposed of with a direction to the Collector, Aligarh that in case, the petitioner files a representation before the Collector, Aligarh bringing all the necessary facts to his notice, the Collector, Aligarh shall get the claim of the petitioner verified and pass appropriate orders on the representation of the petitioner and shall also take consequential action in accordance with law.
