For Petitioner : Mr.V.S.Jagadeesan For Respondent 1 : M/s.S.Pavithra, Standing Counsel https://www.mhc.tn.gov.in/judis W.P.No.20068 of 2025 For Respondent 2 : Mr.C.S.K.Sathish, Standing Counsel ORDER The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to pay interest on the belated payment of terminal benefits namely such as Provident fund amount, Gratuity amount, Commutation of pension amount and Leave Salary amount to the petitioner at the rate of 6% per annum, for the period from (30.06.2023) the date of retirement to till the date of actual disbursement. 2. The case of the petitioner is that he was appointed in the first respondent Transport Corporation and after completion of unblemished service, the petitioner had retired from service on 30.06.2023. However, the terminal benefits have been settled to the petitioner only on 16.04.2025 and no interest has been paid for the belated period. In view of the same, the petitioner has submitted a representation dated 28.04.2025 to the respondents to pay interest for the belated period. The learned Standing Counsels for the respondents would fairly submits that in view of the similar order passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay the interest at the rate of 6% per annum from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
