NIMMAGADDA REVATHI Counsel for the Respondent(S): 1. 2 The Court made the following order: The present revision is filed aggrieved by the inaction in disposing of the execution petition in EP No.69 of 2016 in OS No.81 of 1998 on the file of the Additional Senior Civil Judge, Chittoor. 2. The petitioner filed suit in OS No.81 of 1998 seeking to pass judgment and decree for declaration, delivery of possession of the suit schedule properties and also to pay mesne profits. Upon contest, the said suit was decreed by judgment and decree dated 15.10.2001. Thereafter, the petitioner filed execution petition vide EP No.69 of 2016 on the file of the Additional Senior Civil Judge, Chittoor. Though the execution petition was numbered in the year 2016, the same is not taken up for hearing and thereby, the petitioner could not enjoy the fruits of the decree. The only grievance of the petitioner is that, despite the execution petition being numbered, the execution Court did not take steps to dispose of the same in accordance with law. 3. In view of the above, the revision petition is disposed of directing the execution Court to pass appropriate orders in the execution petition after affording an opportunity of being heard to 3 the petitioner and to the respondents as expeditiously as possible, preferably within a period of six (06) months from the date of receipt of the copy of this order. 4. With the above direction, the revision petition is disposed of. There shall be no order as to costs.
