D/L143 27.11.2025 Bpg. C.R.M. (NDPS) 1023 of 2025 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Palashipara Police Station Case No.14 of 2025 dated 06.01.2025 under Section 21(C) of the NDPS Act, 1985; Arijulla Sekh @ Babu Versus The State of West Bengal Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh. …for the petitioner. Mr. Madhusudan Sur Mr. Debanshu Ghorai. ...for the State. Learned advocate for the petitioner submits that the petitioner is in custody for 10 months and although charge-sheet has been submitted but hardly there has been any progress in the case and the petitioner is unnecessarily languishing in jail. Learned advocate for the State opposes the prayer for bail and submits that 351 grams of heroin were recovered. Having considered that commercial quantity of contraband was recovered, I am of the opinion that Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner in CRM (NDPS) 1023 of 2025 is rejected. Learned trial court is directed to expedite the process of trial. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 2 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
