The present application has been filed by applicants for quashing the charge sheet dated 06.01.2024 as well as cognizance- cum-summoning order dated 22.02.2024 passed by Judicial Magistrate-FTC (Crime Against Women), Basti as well as entire proceeding of Case No.63 of 2024 (State Vs. Mahtab Alam alias Bablu Khan and others), under Sections 498A, 504, 506, IPC and Section 3/4 D.P. Act, Police Station Munderwa, District: Basti arising out of Case Crime No.257 of 2023, pending in the court of Judicial Magistrate-FTC (Crime Against Women), Basti. 3. It is submitted by learned counsel for applicants that First Information Report has been lodged against applicants with the allegation of tripple talaq. Learned counsel for applicants submits that there is no allegation with regard to demand of dowry against applicants in the FIR or in the statement of victim. Learned counsel for applicants submits that applicants have been falsely implicated in the case. 4. Matter requires consideration. 5. Issue notice to opposite party no.2. 6. Opposite parties may file counter affidavit within three weeks. 7. List this case on 3.11.2025. 8. Till the next date of listing, further proceedings in the aforesaid case, shall remain stayed.
