Petitioner has challenged the order dated 23.08.2024 passed by learned District Judge, Nainital in Arbitration Application No.94 of 2020. By the said judgment, the award rendered by District Magistrate under Section 3-G(5) of National Highways Act, 1956 was set aside and the matter was remanded back to Arbitrator/ District Magistrate. 3. Learned State Counsel submits that the writ petition is misconceived, as petitioner has a remedy under Section 37(1)(c) of Arbitration & Conciliation Act. 4. This Court finds substance in the said submission. The order impugned in this writ petition is appealable under Section 37 of Arbitration & Conciliation Act. 5. Learned counsel for the petitioner then seeks permission to withdraw the writ petition, with liberty to approach appropriate forum. 6. Accordingly, the writ petition is dismissed, with liberty sought for.
