JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 20-08-2025 Heard learned counsel for the petitioner and the State. 2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 323,324, 307, 448, 380 and 504 of the Indian Penal Code. 3. As per the prosecution case, when the informant got information that all the FIR named accused persons including this petitioner were assaulting female members of his family with lathi, danda, he rushed to the house and protested. It is alleged that petitioner assaulted on the head of the informant with farsa. Other accused persons also assaulted the informant with lathi and danda and took out cash and ornaments. 4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. petitioner is agnate of informant and there is land dispute between them due to which scuffle took Patna High Court CR. MISC. No.51530 of 2025(2) dt.20-08-2025 2/2 place in which both sides sustained injuries. Case and counter case and the case lodged by petitioner side was earlier in point of time. Petitioner claims clean antecedent. 5. Learned counsel for the State opposes the prayer for bail. 6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikarhana at Dhaka or Successor Court in Ghorasahan (Lakhaura) Police Station Case No. 215 of 2015, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
