1. The Fair Price Shop license of the petitioner was cancelled on 01.08.2024. Aggrieved against the aforesaid statutory appeal preferred before the appellate authority i.e. Joint Commissioner Food and Civil Supply, Gorakhpur Region Gorakhpur. In the said appeal the Joint Commissioner Food and Civil Supply, Gorakhpur Region Gorakhpur passed a detailed order on 17.12.2024, cancelling the
order dated 01.08.2024 and the matter was remitted back before the respondent no.
2. Operative portion of the same reads as follows:-
"तददद्ननुससार द् प्रश्नगतद्आददेशद्ददनसानांक द्01-08-2024 दनरस्त द् दकयसाद् जसातसाद् हहैद् तथसाद् पतसावललीद् अवर न्यसायसालयद्ककोद्इसद्दनदरशद्कदे द्ससाथद्प्रदतप्रदेदषितद्दकयसाद्जसातसाद्हहैद्दकद्अपलीलसानांटद्ककीद्तरफद्सदेद्प्रस्तनुत शपथपतत्रोंद्कसाद्सत्यसापनद्करसाद्ललयसाद्जसायद्तदकोपरसान्तद्अदग्रिम द्कसायरवसाहलीद्ककीद्जसाय।द्आददेशद्ककीद्प्रदतद्कदे ससाथद्अवरद्न्यसायसालयद्ककीद्पतसावललीद्वसापसद्भदेजलीद्जसायद्तथसाद्वसादद्आवश्यकद्कसायरवसाहलीद्अपलीललीय पतसावललीद्दनकदेदपतद्अदभलदेखसागसारद्हको।"
2. Considerable time has already been lapsed but till date no final decision has been taken in the matter by the respondent no. 2.
3. Heard learned counsel for the parties and perused the record.
4. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/District Supply Officer, Gorakhpur to take a final decision in the matter most expeditiously and preferably within a period of six weeks from the date of production of certified copy of this order before him.
5. It is made clear that if any allotment is made the same shall be subject to final outcome.
