Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. Petitioner is aggrieved by the order dated 02.02.2025 passed by respondent no.5-Village Panchayat Officer, Tudipura, Vikas Khand Swar, District Rampur, by which he has directed to deposit Rs.1,20,000/- with the Chief Nodal Account Indian Bank inasmuch as the petitioner was not entitled for the benefit of receiving the amount for construction of house under the scheme floated by respondent for granting assistance for construction of the house. 3. It is contended by learned counsel for the petitioner that the impugned order has been passed without giving any notice and opportunity of hearing to the petitioner. 4. Learned Standing Counsel would contend that since the petitioner was found ineligible for receiving the aid for construction of house, therefore, there is no illegality in the impugned order. 5. Be that as it may, the impugned order reads as under: "कायार्लय ग्राम पंचायत टोडीपुरा िवकास खण्ड स्वार जनपद रामपुर पत्रांक 01/नोिटस 2024-25 िदनांक 02/02/2025 इरफ़ान पुत्र अता हुसैन िनवासी ग्राम टोड़ीपुरा Versus Counsel for Petitioner(s) : Subhash Chandra Pandey Counsel for Respondent(s) : C.S.C. Irfaan .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) ग्राम पंचायत टोडीपुरा िवकास खण्ड स्वार जनपद रामपुर िवषय:- अपात्र पाये जाने पर आवास िनमार्ण हेतु प्राप्त धनरािश जमा करने के संबंध में । उपयुर्क्त िवषयक आपको अवगत कराना है िक पिरयोजना िनदेशक िजला ग्राम्य िवकास अिभकरण रामपुर के पत्र संख्या 658/आिल0/2024-25 िदनांक 08-01-2025 के दवारा िदनांक 11-12-2024 को िशकायतकतार् के द्वारा तीन आवासों के संबंध में िशकायत की गयी थी। िजसके जांचोपरांत आपका आवास पक्का पाया गया तथा आप आवास योजना हेतु अपात्र पाये गए । अतः आपको िनदेर्िशत िकया जाता है िक आप नए आवास िनमार्ण हेतु प्राप्त धनरािश अंकन 120000 रुपये मुख्य नोडल अकाउंट इंिडयन बैंक हजरतगंज (आईएफएससी कोड हजरतगंज IDIBOO0H561) खाता संख्या 50352149914 में जमा कराते हये यू.टी.आर. अधोहस्ताक्षरी को उपलब्ध कराना सुिनिश्चत करें। अन्यथा की िस्थित में आपके िवरुद्ध सुसंगत धाराओं में धाना टाडा में प्राथिमकी दजर् करा दी जाएगी िजसके िलए आप स्वयं उत्तरदायी होंगे। ग्राम पंचात अिधकारी ग्राम पंचायत टोड पुरा िवकास खण्ड स्वार (रामपुर) " 6. The perusal of the impugned order shows that no notice or opportunity of hearing was given to the petitioner. In such view of the fact, we are of the view that the impugned order dated 02.02.2025 could not be sustained in law and accordingly, it is set aside with liberty to the respondent no.2 -Chief Development Officer, Rampur, U.P. to pass a fresh order after giving due notice and opportunity of hearing. 7. Accordingly, the writ petition is allowed with no order as to costs. 8. It is made clear that if there is any concealment of fact by the petitioner in obtaining the present order, the respondents shall have the liberty to file recall application to recall the present order.
