Case of the prosecution, in brief, is that, on 17.ll.2024 at about 22.30 hours, one S.Nageswara Rao (hereinafter referred to, as ldeceased') and his friends lndala Sankar and Siyyadri Suresh were proceeding to Kotha Veedhi on the Pulsar Bike of the deceased. At that time, Al and A2 who were consuming alcohol stopped them and stated "Tagubotu na kodukullara ekkada nundi vastunnaru". On that the deceased replied that he would not fear though they are rowdies and left the place. Indala Sankar dropped the deceased at his house and while he was returning, Al and A2 stopped the motor cycle and took the bike keys, on informing the same to deceased, he went to the accused along with lndala Sankar, then Al lit a cigarette and I--=1 i-t9 ce--i-_ made injury on the left side of the neck of lndala sankar, then A2 I-nstigated Al to kill the deceased. on that, Al took a nearby stI-Ck and beat the deceased on hI®S head at left side, at that time A2 hold the deceased tightly and then Al again beat the deceased twice on his body and caused death of the deceased. 3. Heard. Perused the record. 4. On a perusal of the material on record goes to showthat an altercatI-On took place between the deceased and the accused, whe-n,they were in drunken state. lt is alleged that the petitioner attacked the deceased with a stick nearby and beat the deceased on his head. The petitioner herein was arrested on 18.ll.2024 and since then he has been languishing in jal-I. Learned Assistant Public Prosecutor submitted that major portion of the investigation has been completed and the charge sheet could not be filed for want of RFSL report. It seems that the entire incident is alleged to have taken place when they were I-n drunken condition, 5. In view of the aforesaid facts and circumstances of the case and since major portion of the investigation is completed, this Court is inclined to grant bail to the petitioner herein/Al on the following conditions. I-_: =\-_i c-_=zi3i- i) The petitioner herein/Al shall be released on bail on each of them executing personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Narsipatnam. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 6.
