RAJESH BHARDWAJ , J. (Oral) 1. By way of this common order, I intend to dispose of abovesaid two petitions as they have arisen out of the same FIR. 2. Petitioners have approached this Court by way of present petitions praying for granting them regular bail in case FIR No.44 dated 08.03.2023, under Sections 307, 392, 342, 34, 325, 394 of IPC and Sections 25 & 27 of Arms Act, registered at Police Station Beas, District Amritsar. 3. As per the facts of the case the present case was registered on the statement of complainant, namely, Amit Kumar. It was alleged that he was running a jewellary shop. On 08.03.2023 at about 12:00 pm, 04 youngsters with muffled faces came on activa and motorcycles in front of his shop. One of them stood outside the shop and rest 03 entered the shop. The complainant was threatened and they started looting gold and silver jewellary from the shop. The same was resisted and they started beating them with the weapons. In the fight ensued, they managed to apprehend one of the accused, namely, Gurmeet Singh. The request was made to take legal action against the culprits. On registration of FIR, investigation commenced. During investigation, the apprehended accused, namely, Gurmeet Singh, disclosed about the complicity of the petitioners and thus, they were also arrayed as an accused in the present case. The petitioners were arrested on 10.03.2023 and since then they are behind bars. Petitioners-Ranjit Singh @ Ranjeet Singh @ Goga and Sharmsher Singh @ Shera approached the Learned Additional Sessions Judge, Amritsar praying for grant of bail, however, finding no merit, both the applications were declined after hearing both the sides by Learned Additional Sessions Judge, Amritsar vide order dated 22.02.2024 and 28.03.2024, respectively. Aggrieved by the same, petitioner-Ranjit Singh @ Ranjeet Singh @ Goga earlier approached thrice this Court by way of filing CRM-M-12520-2024, CRM-M-36849- 2024 and CRM-M-60562-2024, however, the same were declined vide orders dated 15.03.2024, 18.09.2024 and 06.02.2025 respectively, passed by this Court and hence, he is before this Court by way of filing of present fourth petition, for grant of bail. Whereas, the present one is the second petition filed by petitioner-Shamsher Singh @ Shera, praying for grant of bail as the first one i.e. CRM-M-44913-2023 was dismissed as withdrawn vide order dated 09.01.2024. 4. Learned counsel for the petitioner(s) has contended that the petitioners have been falsely implicated in the present case. She submits that the petitioners are neither named in the FIR nor any recovery has been POOJA SHARMA 2025.05.29 19:56 I attest to the accuracy and integrity of this document CRM-M-29263-2025 3 CRM-M-29277-2025 effected from them. However, she submits that the petitioners were arrayed as an accused in the present case only on the basis of disclosure statement of co-accused, namely, Gurmeet Singh, which is not even an admissible evidence. She submits that during trial 03 of the witnesses have not supported the case of prosecution and thus, they have turned hostile. She submits that co-accused, on whose disclosure the petitioners were arrayed as an accused, had approached the Hon’ble Supreme Court and he has been granted bail by the Hon’ble Supreme Court vide order dated 08.05.2025 passed in SLP (Crl.) No.16461 of 2024. She thus, submits that when the main accused has already been granted bail by Hon’ble the Supreme Court, the petitioners deserve to be granted bail. 5. Learned State counsel, on instructions, has opposed the submissions made by the counsel for the petitioners and submits that the complicity of the petitioners were established during the investigation, however, he has accepted the fact that the petitioners were arrayed as an accused on the basis of disclosure statement of co-accused, Gurmeet Singh, who has already been granted bail by the Hon’ble Supreme Court. He has produced the custody certificate of the petitioners in the Court. 6. On hearing counsel for the parties and perusing the record, it is deciphered that the petitioners were arrayed as an accused on the basis of disclosure statement of co-accused, Gurmeet Singh, however, he has already been granted bail by the Hon’ble Supreme Court. As submitted before this Court, 03 witnesses have not supported the case of the prosecution, however, out of total 17 prosecution witnesses, 04 witnesses have been examined so far. 7. The veracity of the allegations would be assessed only after the conclusion of the trial and on the appreciation of evidence to be led by POOJA SHARMA 2025.05.29 19:56 I attest to the accuracy and integrity of this document CRM-M-29263-2025 4 CRM-M-29277-2025 both the parties before the trial Court. The trial of the case will take sufficiently long time. Thus, keeping in view the overall facts and circumstances of the case, this Court is of the opinion that learned counsel for the petitioners succeed in making out a case for grant of regular bail. Accordingly, both the petitions are allowed. Petitioners are ordered to be released on bail on their furnishing bail/surety bonds to the satisfaction of the concerned Trial Court/Duty Magistrate. Nothing said herein shall be treated as an expression of opinion on the merits of the case. 8. Photocopy of this order be placed on the file of other connected cases.
