Present petition has been filed with a prayer to direct the respondent no. 2 and 3 to conclude the fair and impartial investigation in pursuance of the First Information Report dated 8.4.2025, lodged by the informant/petitioner against the accused persons in Case Crime No. 0170 of 2025, under Section 305, 329(3), 127(2), 131, 351(2) BNS, P.S. Banda, District Shahjahanpur. 3. On perusal of record, we find that first information report is dated 8.4.2025 whereas the petition has been filed on 17.5.2025 with undue haste. 4. Accordingly, the present writ petition stands disposed of in the light of the judgment passed in the case of Ajay Kumar Pandey versus State of U.P. and 2 others 2021 (2) ADJ 239 by granting liberty to the petitioner to invoke the power of the Magistrate concern under Section 175 (3) BNSS, if the need so arises.
