The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to extend them notional benefit.

Pursuant to Advertisement No.3/2016 dated 20.2.2016 (Annexure P-1), the petitioners applied for the post of Shift Attendant under Economically Backward Persons in General Category (for short ‘EBPG’). The respondent declared result on 08.03.2019. The petitioners came to be selected and were given appointment letter on 09.03.2019. Few candidates challenged EPBG reservation. On account of an interim order, the respondent-State did not permit them to join. The interim order was modified and the petitioners were permitted to join in October’ 2020. They are claiming that they should be extended deemed date of appointment. They were not at fault, thus, for all intents and purposes their date of joining is
09.03.2019.

Learned counsel for the petitioners contends that similarly situated employees have been extended benefit of deemed date by other departments such as Haryana Forest Department. The grievance of the petitioners, at this stage, would be resolved if the respondent is directed to redress their grievance in a time bound manner by treating the instant petition as representation.

Ms. Rajni Gupta, Additional Advocate General, Haryana, who on advance notice is present in Court on behalf of the respondents, assures the Court that competent authority would decide claim of the petitioners in accordance with law within three months from today.

In the wake of statement of learned State counsel, the present petition stands disposed of.
