Accused No. 1 in S.C. No.79 of 2019 pending before the Court of I-Additional District and Sessions Judge, Dharwad, sitting at Hubballi, arising out of Crime No.88 of 2018, registered by Bendigeri Police Station, Hubli South Sub- Division, Hubballi-Dharwad for the offences punishable under Sections 323, 324, 307, 302, 504, 506 read with Section 34 of the IPC, is before this Court in this successive bail application filed under Section 439 of the Cr.P.C., seeking regular bail. 2. Learned HCGP brings to the notice of this Court that the petitioner's earlier bail application filed before this Court in Criminal Petition No.101239 of 2025 was rejected on 01.04.2025 with a direction to the trial Court to conclude the trial on or before 30.06.2025 taking into consideration that he is in custody from 02.12.2018. She submits that the time granted by this Court to conclude the trial has been thereafter extended at the request of the trial Court till 31.10.2025. She submits that the prosecution will close its side of evidence on - 3 - HC-KAR NC: 2025:KHC-D:10979 CRL.P No. 103019 of 2025 or before 30.09.2025 and the main case itself can be disposed of before the trial Court within the extended time granted by this Court. She submits that at this stage, in the event the petitioner is enlarged on bail, the trial may be unnecessarily delayed in the event the petitioner does not cooperate before the trial Court. 3. At this stage, learned counsel for the petitioner submits that this criminal petition may be dismissed as not pressed, with liberty to the petitioner to renew his bail application before this Court, in the event the case is not disposed of before the trial Court on or before 31.10.2025. 4. The said submission is placed on record. 5. This Criminal Petition is dismissed as not pressed, with liberty as prayed for. All contentions urged are left open.
