This writ petition has been filed with the following prayer: "1) A writ order or direction in the nature of mandamus commanding and directing the Respondent no. 2 (Sub Divisional Magistrate, Tamkuhiraj, District Kushinagar.) to consider and decide the Appeal No. 7947/2024 Computerized Case No. T2024054403 07947 (Asha Kumari Versus Rammilan) under section 35(2) U.P. Revenue Code 2006. within stipulated period which is pending since 18.01.2023." It is contended that Appeal No.7947 of 2024 (Computerized Case No.T2024054403 07947) filed under Section 35(2) U.P. Revenue Code 2006 is pending consideration before respondent no.2- Sub Divisional Magistrate, Tamkuhiraj, District Kushinagar. The sole prayer made in the writ petition is to expedite the said appeal. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Sub Divisional Magistrate, Tamkuhiraj, District Kushinagar to decide Appeal No.7947 of 2024 (Computerized Case No.T2024054403 07947) filed under Section 35(2) U.P. Revenue Code 2006, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
