The Petitioner is before this Court seeking the following prayer: a) Set aside the Notification dated 17-07-2025 bearing No.TD 213 TCO 2024 issued by the R-1 Vide annexure-C. b) Issue writ of mandamus directing the R-3 to consider the representation filed by the petitioners and directed to pay the 18 months arrears and other benefits dated 29-12- 2023 Annexure-A. c) Pass such other order as this Hon’ble Court deems fit and proper under the facts and circumstance of the case to meet the ends of justice and equity. 2. Learned counsel for the petitioner submits that the first prayer of the petition would not survive for consideration. What remain is for consideration of representation of payment of arrears for period of 38 months. 3. Learned counsel Sri.Prashant Hosmani, appearing for the respondent No.3, submits that the charter of demands is being considered before the Assistant Labour Commissioner. Therefore, it is open for the petitioner to approach the Assistant Labour Commissioner along with others in the same relief. 4. Learned counsel appearing for the petitioner submits that the petitioner would avail such remedy by joining the proceedings before the Assistant Labour Commissioner, where - 4 - HC-KAR NC: 2025:KHC-D:15184 WP No. 105459 of 2025 the charter of demands are being considered along with the grievance of the petitioners as prayed.
