The petitioner is before this Court seeking the following prayer: “a. mandamus directing the respondents to extend the benefit of the circular 24.11.2004 ¸À (11)1244/±É 90 vÀÄ.¨sÀ.40/ 2003-2004 vide Annexure-c by considering the representation of the petitioner for including 90% of dearness allowances to the basic pay of the petitioner. b. Any other direction or order deem fit and proper in the circumstances of the case.” 2. The petitioner retires on attaining the age of superannuation in the year 1995. At the time of retirement of the petitioner, he was not entitled to 90% of the dearness allowance that every employee would become entitled to in future. A circular comes to be issued by the State in the year 2004 entitling the petitioner and the like for dearness allowance - 3 - HC-KAR NC: 2025:KHC-D:16868 WP No. 108599 of 2017 for those who have retired between 01.04.1995 to 31.03.1998. In terms of the said circular, the petitioner then submits a representation on 24.02.2009. The representation is followed by another representation of the year 2017 and that having not been - 5 - HC-KAR NC: 2025:KHC-D:16868 WP No. 108599 of 2017 considered, the petitioner is at the doors of this Court seeking a direction to consider the representation. 5. The petitioner who is now an octogenarian claims to be entitled to the benefit between 1995 to 1998, at the time when he retired, 90% of dearness allowance to the basic pay of the petitioner for recalculation of pension. Therefore, as observed herein above, the representation of the petitioner has not been considered. 6. Learned HCGP would submit that if the representation of the petitioner is not considered as on today, the same shall be considered within an outer limit of twelve weeks from the date of receipt of a copy of this order strictly in accordance with law. 7. The submission is placed on record. I deem it appropriate to dispose the petition with a direction to the respondent - State to consider the representation of the petitioner and pass necessary orders in accordance with law within an outer limit of twelve (12) weeks from the date of receipt of a copy of this order, if not earlier.
