Through the medium of the present petition, the petitioners have challenged the Charge-sheet No. 08 dated 12.12.2024, filed for offences under Section 120 (B) read with Section 420 RPC, Section 5 (2) read with Section 5 (1) (d) of Jammu and Kashmir Prevention of Corruption Act against the petitioners and the proceedings emanating therefrom which is stated to be pending before the court of learned Special Judge, Anti-Corruption (CBI Cases) , Srinagar. 04. Reply to the instant petition has ben filed by the respondents wherein it has been submitted that the present petition is premature, inasmuch as the sanction for prosecution in respect of one of the accused is yet to be obtained, and no cognizance has been taken by the learned Special Judge. 03.
