Neutral Citation No. - 2025:AHC:88994 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5475 of 2025 Petitioner :- Faheem Bano Zaidi Respondent :- Saroor Fatma And 5 Others Counsel for Petitioner :- Virendra Kumar Shukla Hon'ble Rohit Ranjan Agarwal,J. 1. This is plaintiff's petition. 2. In the suit instituted by plaintiff, an application for grant of temporary injunction 6C was moved which was initially allowed by trial court but on the objection/application preferred by defendant, the said order was withdrawn and the application has to be decided de novo. 3. Through this writ petition, petitioner has challenged the order recalling earlier temporary injunction. 4. This Court finds that as the application 6C is still pending consideration before trial court, no interference is required in the order impugned. 5. However, trial court is hereby directed to decide the 6C application pending in Suit No. 1123 of 2023, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. 6. With the aforesaid directions, writ petition stands disposed of. 7. It is made clear that this Court has not adjudicated the matter on merits.
