ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer. “a. Issue a writ, order or direction in the nature of mandamus, directing the respondents 4 and 5 submit the same along with service register of petitioner to the concerned educational authorities for sanction of pension and other service benefits to the petitioner at the earliest. To consider the representation made by the petitioner dated 16-08-2022, 18,01-2023, 21-01-2023 submitted to respondent No.4 and 5 herein is produced as Annexure-B, B1 and B2. b. Any other writ or direction which this Hon’ble Court deems fit to grant in the facts and circumstances of the case may kindly be granted in favour of the petitioners along with cost of this petition in the ends of justice and equity.”

The petitioner, a retired Physical Education Teacher is before the Court seeking grant of pension on account of the fact that he is not granted pension at the hands of the respondents. The issue is that there are two wives claiming to the pension of the retired Physical Education Teacher. 3. The learned counsel for the petitioner submits the petitioner has placed a memo before the Court in the earlier

proceedings with regard to distribution of the terminal benefits between the wives. 4. The learned counsel for the respondent Nos.4 and 5 submits that the papers of pension have been already furnished to the State and the same has not yet been processed. 5. The learned HCGP submits that if reasonable time is granted, the papers in the petition would be processed and appropriate orders would be passed and granting pension if not already granted. 6. It is open to the respondent State to solicit any kind of documents necessary from the hands of the petitioner. The action shall be taken within the outer limit of four months from the date of receipt of the copy of this order. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE
