GUNESHWAR SHARMA Order 18.02.2025 [1] Heard Mr. H. Maipaksana, learned counsel appearing on behalf of the petitioner as panel counsel, High Court Legal Service Committee and Mr. N. Amarjit, learned counsel for the Union Public Service Commission. [2] The petitioner who is aspirant for Civil Service Exam approached this Court for a direction to the respondent to allow him to submit online registration form to appear for Civil Service (Prelim) Examination 2025 and to dispose of the representation dated 07.02.2025 submitted by the petitioner to the respondent in this regard. [3] It is stated that the petitioner appeared in the previous Civil Service Examinations and was unsuccessful. He tried to submit application for the Civil Service (Prelim) Examination 2025 but the same was rejected as age bar. On earlier occasion, the petitioner could not appear the examination due to medical and some pending cases. In this respect, the petitioner also submitted a representation dated 07.02.2025 to the Secretary, Union Public Service Commission for age relaxation. However, the representation is still pending with the respondent. [4] Learned counsel for the petitioner submits that today is the last date for submission of the registration form. At this stage, learned counsel for the petitioner submits that the respondent be directed to dispose of the representation dated 07.02.2025 and consider the case of the petitioner sympathetically. [5] Mr. N. Amarjit, learned counsel for the UPSC, submits that as per the record, it is clear that the petitioner’s application was rejected as he is overage and as per the prevailing rule, his application cannot be accepted unless the rules are relaxed by the competent authority. [6] Mr. H. Maipaksana, learned counsel for the petitioner, submits that the respondent be directed to dispose of the representation dated 07.02.2025 so that the petitioner may get one last opportunity for appearing the said examination. [7] Learned counsel for the respondent submits that no mandamus lies for relaxing upper age limit for appearing in the public employment. [8] Recording the submissions made at the bar and with the peculiar prayer of the learned counsel appearing as legal aid counsel, writ petition is disposed of by directing the respondent to consider and dispose of the representation dated 07.02.2025 as per rule, preferably within a period of one month from the date of receipt of a copy of this order. [9] It is clarified that this Court does not express any opinion on the merit of the case. [10] With this observation, writ petition is disposed of.
