The present writ petition has been filed with the grievance that the respondent nos. 6 to 8 are indulging in illegal mining over Plot Nos. 16, 17, 19 and 20 which are the Bhumidhari plots of the petitioner. The Standing Counsel has obtained instructions and on the basis of his instructions states that no mining is being done in Plot No. 20 and mining lease have been granted to respondent nos. 6, 7 and 8 for mining in Plot Nos. 16, 17 and 19. The orders granting mining lease to respondent nos. 6, 7 and 8 have not been challenged before any authority and are also not under challenge in the present writ petition. The petitioner has the right to obtain compensation under Rule 68 of the Uttar Pradesh Mining Mineral (Compensation) Rules, 1921 which he may exercise. The relief to restrain respondent nos. 6 to 8 from exercising their rights under the mining lease is rejected. With the aforesaid observation, the writ petition is disposed of.
