The applicant intends to challenge the judgment and order of conviction dated 05.07.2023 passed by Additional Sessions Judge, Hinganghat in Sessions Case No.127/2017 thereby convicting the appellant under Sections 302 and 324 of the Indian Penal Code. 3. Learned counsel for the applicant submits that delay is caused because applicant is behind the bar and has restrictions on movement. The applicant is in financial crisis and therefore, could not appoint Advocate. Ultimately he was informed of Legal Aid Services. He approached the Authority and thereafter counsel has been appointed. 2 905 appa 930.25.odt..odt 4. Learned APP submits that delay is not properly justified. 5. However, considering the fact that applicant is in jail and was in financial crises, he could not appoint the counsel. 6. In view of above and for the reasons set out in the application, the application is allowed. Delay is condoned. 7. The appeal shall be registered in accordance with Rules. CRIMINAL APPEAL ST.
