JUSTICE ROBIN PHUKAN ORDER 21.03.2025 Heard Ms P Agarwala, learned counsel for the applicants and Mr D Mazumdar, learned counsel for the respondent Nos. 1, 2 and 3. Page No.# 5/5 2. This application under Section 5 of the Limitation Act, is preferred by the applicants for condonation of delay of 907 days in filing substitution petition of the legal heirs of respondent No. 1 and also for condonation of delay of 3078 days filing substitution petition of the legal heirs of respondent No. 3. 3. The learned counsel for the applicants submits that during the pendency of the RSA No. 84/2011, respondent Nos. 1 and 3 suffered demise and in their place, their legal heirs are required to be substituted and there was some delay in filing the application and the same was not intentional and, therefore, it is contended to allow this application. 4. Mr Mazumdar, learned counsel for the respondent Nos. 1, 2 and 3, submits that he has no objection in the event of allowing this application. 5. Having heard the submissions of learned Advocates for both the parties, I have carefully gone through the application and the documents placed on record and taking note of the submissions of learned counsel for both the parties, this Court is inclined to allow this application. 6. The delay of 907 days in respect of respondent No. 1 and 3078 days in respect of respondent No. 3, stands condoned. 7. In view of above, learned counsel for the applicants shall file corrected cause title of RSA No. 84/2011, within one week from today. 8. In terms of above, this interlocutory application stands disposed of. JUDGE Comparing Assistant
