The learned counsel for the petitioner has filed application under Section 482 r/w. Section 320 of Criminal Procedure Code1 along with the affidavit stating that, the matter has been settled between the parties. 3. The averments of the affidavit of respondent No.2-complainant accompanying the application are as follows: “2) The Petitioner is challenging entire FIR and Complaint and further investigation/proceedings in Crime No.228/2025 in Badami P.S. pending on the file before Learned Prl. Civil Judge and JMFC Court, Badami for the offences punishable under sections 115(2), 126(2), 351(2), and 352 of BNS 2023 as against the petitioner / accused. Myself/Complainant and the Petitioner/Accused have agreed to live peacefully by condoning and regretting the incident happened on 28/10/2025 looking to the good neighborly relationship. 4) I submit that myself and the Petitioner are relatives and there is no consideration of money in resolving the dispute. 5) I have agreed not to pursue the above complaint and FIR and withdraw the same in view of the amicable resolution of the dispute since the petitioner has agreed to withdraw the Crl. Petition and not to press for any proceedings.” 4. Having considered the averments made in the affidavit accompanying the application, it is appropriate to record the compromise as prayed for. 5.
