Mr. M.C. Pant, Advocate for the petitioner. Mr. Rajeev Singh Bisht, Additional C.S.C. for the State/respondents. The petitioner is Assistant Teacher (L.T.) Agriculture in Government Inter College, Chamiala, Tehri Garhwal and he is currently posted at Government Higher Secondary School, Ramnagar, Roorkee. He is going to retire on 30.05.2025. As per Government Order, he is entitled to sessions benefit in view of the welfare of the children. Therefore, the petitioner seeks direction to the respondents to allow the sessions benefit to the petitioner in view of the Government Order dated 08.04.2021 and 20.09.2011 Heard learned counsel for the parties and perused the record. In this matter, learned State counsel was required to get instructions. Today, learned State counsel would submit that the petitioner has not moved a formal application for sessions benefit. It is only therefore, his candidature could not be considered.
Learned counsel for the petitioner though submits that he had already submitted an application to the respondents/authorities, but they have not given any receipt of the acknowledgment.
Learned counsel for the petitioner would submit that the petitioner would submit a fresh application to the respondent no.6 within two working days from today. He seeks directions to the respondent no.6 to forward it immediately and an action may be taken on his application before he
retires. Learned State counsel would submit that in case, the petitioner submits an application to the respondent no.6 within two days, the decision by the competent authority shall be taken on it within a period of seven days from then. The Court takes on record the statement made by learned State counsel. The writ petition is disposed of with the liberty to the petitioner to move an application to the respondent no.6 within a period of two working days, with a further direction to the respondent no.6 that as soon as the application is received, he shall forward it to the competent authority without delay. The competent authority is
directed to take a decision in the matter within seven days of its receipt.
