Pursuant to earlier order, instructions have come which are taken on record. 2. Learned Standing Counsel submits that proceedings under Section 67 of U.P. Revenue Code, 2006 for eviction of the private respondents has already been initiated and an order was passed. Subsequently, person against whom eviction proceeding has been filed, has filed a restoration application which is pending consideration. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Tehsildar (Judicial), Tehsil-Sadar, District-Azamgarh to decide the Case No. 11803 of 2023, under Section 67 of U.P. Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
