3. Per contra, learned Public Prosecutor opposes the bail application and contended that petitioner is a habitual offender and against him seven criminal cases are pending which includes offence under 3/25 and 4/25 of the Arms Act and Section 302 of IPC. Therefore, considering the criminal antecedents of the accused-petitioner, his second bail application deserves to be dismissed.
4. Heard and perused the material available on the record.
5. Considering the arguments advanced by the counsel for the parties and looking to facts that accused petitioner is in custody since 25.11.2024 and the trial of the case will take considerable time. Though there are criminal cases pending against the petitioner, however considering the period of custody and probable time which take in trial, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ajeet Kumar @ Dana S/o Shri Virendra Singh, in connection with FIR No. 491/2024 registered at Police Station Behror, District Kotputli- Behror shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge.
