01. The case of the petitioner in nutshell is that she being an unemployed woman, applied for financial assistance under the PMFME Scheme and completed all the required formalities, including resolution, documentation and an undertaking. That she invested personal assets for starting her proposed Unit/Company, i.e., Muneera Natural Process Private Limited and also obtained necessary approvals, confirming the legal existence of her company under the companies Act, 2013. That she has also obtained a certificate of incorporation and memorandum of association, which evidences the existence of foundational structure of her business Unit. That she also obtained Udyam registration and GST registration for ensuring that her enterprise is recognized under relevant Government frameworks. That she also facilitated the recognition of her Unit under the start-up India initiative. That upon completion of necessary formalities her application was Mohammad Yaseen Dar I attest to the accuracy and authenticity of this document
duly processed by the concerned authorities and she was required to furnish an undertaking to the effect that she would not misuse the Government funds, which also she did. That after finalization of her financial assistance case under the aforementioned scheme at the Government level, same was forwarded to the J&K Bank at its lead office and Branch Akingam level in the year January, 2024 for further processing and disbursement of due assistance. That unfortunately the J&K Bank has been showing no interest in finalization of her case at the Bank’s level for release of the due financial assistance, which has multiplied her hardships and she is accordingly, likely to suffer an irreparable loss, as a result of the dilly delaying tactics of the J&K Bank.
02. In the facts and circumstances of the case, this Court is of the opinion that the matter can be disposed of at this threshold stage by passing an appropriate direction, which otherwise is meant to be obeyed, in the given
facts of the case. Accordingly, the instant petition is disposed of with the direction to all the respondents especially the Jammu and Kashmir Bank through its zonal head, Anantnag and Branch Manager, Akingam Anantnag to expeditiously process the case of the petitioner for her financial assistance under PMFME Scheme, strictly in accordance with the guidelines/regulations of the governing scheme and submit a status report to the Registry of this Court within a period of four weeks.
