12.12.2025 Court No.28 Item No.7 ssi CRM (A) 3539 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Kaliachak Police Station Case No. 1058 of 2025 dated 16.06.2025 under Sections 191 (2)/191(3)/190/126(2)/118 (2)/109(2)/3(5) of the BNS 2023 corresponding to Sections 147/148/149/341/326/307/34 of the Indian Penal Code read with Sections 25 (1-B) (a)/27/29 of the Arms Act, 1959. And In the matter of: Ektar Sk @ Seikh @ Kalu ….Applicant/Petitioner Mr. Abhimanyu Bannerjee Mr. Arnab Saha …for the petitioner Mr. Saibal Bapuli, Ld. APP Mr. Debanshu Ghorai ..for the State Head the learned counsels for the parties. Perused the case diary. Considering the incriminating materials available in the case diary including the injury report showing infliction of gunshot injury on the victim and the statements of neighbors, specifically taking the name of the petitioner as one of the miscreants and the rejection of an application for anticipatory bail of a similarly circumstanced co- accused, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. (Jay Sengupta, J.)
