4. By means of the present writ petition, the petitioner has put to challenge F.I.R. No.0087 of 2025 dated 29.03.2025, under Sections 309(6), 318(4) and 61(2)(a) of B.N.S. 2023 registered at Police Station Sitarganj, District Udham Singh Nagar.
5. The only argument advanced by learned counsel for the petitioner is that in the F.I.R. one person whose name is similar to his own – Gurmel Singh resident of Kuthuliya, Nanakmatta, Udham Singh Nagar, is made an accused and on that basis the Police is after him.
6. It is further submitted by learned counsel for the petitioner that name of the petitioner is not Gurmel Singh but Gurmez Singh s/o Santosh Singh though the resident of the same address.

Learned counsel for the petitioner submits that due to this defect in the F.I.R. the petitioner is being harassed by the Police.
8. Per contra, learned State counsel, on instructions, submitted that during investigation, it has come out that Gurmez Singh @ bunty @ kanti s/o Santosh Singh have the same residential
2025:UHC:3624 address, therefore, the petitioner cannot have the benefit of mention of Gurmel name in the F.I.R.
9. Having considered the submission of the
learned counsel for the petitioner as well as State, this Court is of the view that this discrepancy in the F.I.R. would not come to rescue of the petitioner at this stage.
10. Since the offences alleged against the petitioner are very serious in nature, petitioner is not entitled to get any protection from this Court.
11. Accordingly writ petition is dismissed in limine.
