THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioners are before this Court seeking the following prayer:
A. “Issue a Writ in the nature of Mandamus or directions or order, directing the Respondent Nos 3 not to interfere with the Civil Dispute and pressurize the Petitioners to arrive at settlement at their terms in respect of title to the petition lands;
B. Issue a Writ, Order of Directions in the nature of Mandamus or otherwise to take legal action against the Respondent Nos. 6 to 8 and others on the complaint filed by the Petitioner Nos. 2 for their illegal entry, assault on the petitioners without being yielded to the illegal gratification by the Respondent Nos. 6 to 8,
C. Any appropriate Writ/Order or direction as deemed fit and proper be issued”. 2. A writ of mandamus is sought directing the 3rd respondent–SHO not to interfere in the civil dispute and not to pressurize the petitioners to arrive at a settlement. The allegation is that the police are attempting to mediate and settle the dispute. 3. Such a submission, made in thin air, cannot be accepted. - 4 -

4. It is submitted that a case and a counter-case have been registered, one at the instance of the petitioners and the other against the petitioner and the police are investigating both matters. 5. The prayer now sought would indirectly amount to restraining the police from conducting the investigation, which cannot be granted. 6. If the petitioners are aggrieved by any specific action of the police, it is always open to the petitioners to avail appropriate remedies in law. 7. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE
