For the Respondents: Mr. Vishwas Kaushal, Advocate. Bipin Chander Negi, Judge (oral). The contesting parties to the present appeal have entered into a compromise. The same is in writing and has been duly signed by the contesting parties. The relevant terms of the compromise, in terms of which the matter inter se the contesting parties has been compromised is being reproduced hereinbelow:- 1. That according to the compromise between the parties, the second party do hereby admit claim of the plaintiffs in the suit and they admit that the judgment and decree passed by the learned Senior Civil Judge, Hamirpur in Civil Suit No.161/2012 dated 01.11.2018, titled as “Suresh Kumari etc. versus Sh. Ashish Thakur and Others” is legal and valid and they shall remain bound by this judgment and decree. 2. That in view of the above, the Second Party have agreed and decided that the judgments and decree 1 Whether reporters of Local Papers may be allowed to see the judgment? YES 2 passed by the learned District Judge, Hamirpur in Civil Appeal No.172/2018 dated 16.12.2020 titled as Gagan Singh etc. Versus Suresh Kumari etc. shall be deemed to have been set aside because they do not press that appeal. 3. That the First Party for the aforesaid reason do not press RSA No.20/2021 titled as “Smt. Suresh Kumari and Ors. Versus Sh. Gagan Singh and Ors.” because on the basis of compromise arrived at between the parties, the judgment and decree passed by the Ld. Senior Civil Judge, Hamirpur in Civil Suit No.161/2012 dated 1.11.2018 titled as “Suresh Kumari etc. versus Sh. Ashish Thakur and Others” shall be deemed to have been restored. Parties shall remain bound by the compromise and decree of Ld. Trial Court dated 1.11.2018.” 2. In terms of the compromise arrived at, the entire dispute inter se the contesting parties stands settled. Decree be prepared accordingly. The compromise shall form a part of the decree.
